BUSINESS PURPOSE ONLY: This website is intended solely for professional property developers, SPVs, LLPs, limited companies, institutional counterparties and business-purpose property transactions. This website is not intended for consumers, owner-occupiers, personal borrowers, retail borrowers or personal residential mortgage enquiries. By using this website, Users confirm that all enquiries relate solely to business or investment purposes.
  2. INFORMATION ONLY: All information contained on this website is provided for general informational purposes only and does not constitute financial advice, lending advice, investment advice, legal advice, tax advice or a recommendation of any kind. Nothing on this website constitutes an offer to lend, invitation to borrow, commitment to fund or recommendation to enter into any financial transaction.
  3. NO LENDING ACTIVITY: Shanly Finance does not lend money, provide credit, issue facilities, underwrite loans, approve applications or enter into finance agreements. All finance facilities are provided solely by independent lenders operating separately from Shanly Finance.

  5. INDEPENDENT LENDER DECISIONS: Any lender reviewing an opportunity introduced through Shanly Finance acts entirely independently and at its sole discretion. All underwriting, due diligence, pricing, legal review, valuation review, security review and credit decisions are undertaken solely by the lender. Shanly Finance has no authority over lender decisions and accepts no responsibility for any approval, rejection, delay, withdrawal, amendment or enforcement action.
  6. NO NEGOTIATION OR MEDIATION: Shanly Finance does not negotiate lending terms on behalf of borrowers or lenders and does not mediate lending transactions. Any discussions regarding terms, pricing, facilities, security or legal arrangements take place directly between the borrower and the relevant lender and/or their professional advisers.
  7. NO CLIENT MONEY: Shanly Finance does not receive, hold, control, distribute or safeguard client money. All funds move directly between lenders, borrowers, solicitors and authorised third parties. Shanly Finance does not operate payment services, escrow services or banking services.
  8. AFFILIATED LENDERS: Certain lenders may be affiliated, associated or commercially connected with Shanly Finance. Notwithstanding any such affiliation, all lenders act independently in making underwriting, credit and commercial decisions and all lending agreements are entered into directly between the borrower and the lender.
  9. USER RESPONSIBILITIES: Users are solely responsible for ensuring that all information submitted to Shanly Finance is accurate, complete, lawful, current and not misleading. Users must not submit false, fraudulent, deceptive or unlawful information. Shanly Finance accepts no liability for inaccurate or incomplete information provided by Users.
  10. NO GUARANTEE OF FUNDING: Submission of information to Shanly Finance does not guarantee lender interest, funding, indicative terms, credit approval, refinancing or completion of any transaction. Shanly Finance makes no representation regarding the availability of finance, likelihood of approval, project viability or commercial success.
  11. NO RELIANCE: Users acknowledge that any information provided by Shanly Finance is general commercial information only. Users must not rely upon Shanly Finance as a substitute for independent professional advice, due diligence or lender assessment.
  12. LIMITATION OF LIABILITY: To the fullest extent permitted by law, Shanly Finance excludes all liability for loss of profit, loss of opportunity, failed transactions, funding delays, lending losses, project losses, indirect losses, consequential losses and economic losses arising from use of this website or any interaction with lenders.
  13. INDEMNITY: Users agree to indemnify and hold harmless Shanly Finance and its officers, employees, contractors and affiliates against any claims, liabilities, losses, damages or costs arising from inaccurate information, unlawful conduct, misuse of the website, breach of these Terms or disputes between borrowers and lenders.
  14. THIRD-PARTY PROFESSIONALS: Borrowers and lenders may engage solicitors, valuers, surveyors, accountants, consultants and other third parties. Shanly Finance is not responsible for the acts, omissions, advice or conduct of any third party.
  15. COMPLIANCE & AML: Users must comply with all applicable laws including anti-money laundering, sanctions, anti-bribery and tax laws. Shanly Finance reserves the right to request identification, source of funds information and supporting documentation and may refuse or terminate engagement where compliance concerns arise.
  16. WEBSITE USE: Users must not misuse this website, interfere with systems, upload unlawful material, attempt unauthorised access, introduce malware or use the website for fraudulent or unlawful purposes.
  17. INTELLECTUAL PROPERTY: All content, branding, systems and materials on this website remain the property of Shanly Finance or its licensors and may not be copied, reproduced or commercially exploited without prior written consent.
  18. GENERAL: Nothing on this website creates any partnership, joint venture, fiduciary relationship or agency relationship between Shanly Finance, borrowers or lenders. Shanly Finance may amend these Terms at any time without notice. Continued use of the website constitutes acceptance of the updated Terms. These Terms are governed by the laws of England and Wales.
